do you know who really owns your mortgage?
« on: February 13, 2011, 23:28:42 PM »
Has anyone come across a situation where a mortgage has been fraudulently left on their property which is then transfered to a 3rd party, then reassigned to a 4th and then to a 5th party before you can track them down?  Does anyone know if the transfer and subsequent ownership of that debt is recorded by some kind of agency?  All help would be gratefully received

A mortgage is a charge held on your property and as such is registered as a debt belonging to the Mortgagee not the owner of the property.  Was hoping you would pick up as with your wealth of all things Turkish - am sure you will be able to offer some sound advise.  Thanks in advance

Thank you for the lesson. Your mortgage is your mortgage. Nobody else can "own" your mortgage but you. What I think you need to do is tell us what has happened, enough of this 4th party and 5th party nonsense. We'll help all we can.

Our Tapu was transferred into our names by our builder before we had made the final "stage" payment to him.  At the time he put a mortgage on our Tapu equal to the amount still outstanding.  When the final payment was made to him he signed a receipt at our Turkish Solicitors stating that he had no further "interest" in our property and that he was going to remove the mortgage the following day.

6 years on we found out that the mortgage was never removed and we have had to take the builder to Court.

The builder has since assigned the mortgage to a 3rd party who we have had to join in to the court file at additional expense and we have just found out that that person has  assigned the debt to someone else who has now assigned the debt to someone else.

Can you help with some advise - surely there must be an Agency that records the ownership/transfer so that we can stop this happening again before we can get the 3rd/4th/5th party to Court?

Any help would be appreciated

Obviously part of the A1 Estate agency legacy. I think that it will turn out to have been a "Bank Credit", & not a mortgage per se. Fly barstewards!! [:(!] I think you are going to have an uphill struggle, bonny lad!!

your time span of 6 years probably is not a mortgage, it is a bank credit, a loan, debt, bank, friend or whatever,  smart move on the builders part, written confirmation that he has nothing further to do with your property, no comeback.

Debt is secured on the property, will show if you want to sell, or the 'creditor' wants their money they come to the owner of the property.

(too late for all this now, brain frazzled)
